Psychiatric injury law reforms suggested by the Association of Personal Injury Lawyers


The current law demands a “close tie of love or affection” between the injured person or deceased and the person claiming compensation for psychiatric injury. Close ties are assumed between spouses, fiancés, parents and children and closeness in other relationships has to be proven, for example the closeness between brothers and sisters, grandparents and grandchildren.

Employment law change - statutory discrimination questionnaires abolished


The current law allows a person who thinks that he or she may have been unlawfully discriminated against, harassed or victimised to obtain information from his or her employer by means of a prescribed questionnaire procedure. Employment tribunals are able to draw an adverse inference from an employer’s failure to answer, or from an evasive or equivocal answer.
