Registering a design - our litigation lawyers discuss a recent case concerning intellectual property rights of a sports shoe design

The European Union General Court has just rejected an application to register a intellectual property right in the form of parallel strips on a sports shoe. In doing so the Court took the view that the stripes were nothing more than “a rather banal generic embellishment” and that the design lacked “originality”. Partner Andrew Petchey who has himself just defended a European design right case says “unfortunately it looks like it is back to the drawing board and no doubt an expensive exercise for the Applicant!”.

Grounds for divorce - does calling someone a "fat elephant" qualify? Our family lawyers explain with the aid of an Indian case

Judges in India recently ruled that insulting a spouse about their obesity could provide legal grounds for divorce. The case concerned a woman who taunted her husband about his weight calling him a fat elephant. The husband said his wife regularly humiliated him for being overweight and one of the Judges commented that such name-calling, even if the husband was overweight, was bound to strike at the husband’s self-respect and self-esteem.
