Employment settlement negotiations – employers warned to beware of wording used in offers of settlement. Our employment lawyers explain


An employer and employee were in dispute concerning commission payments. As part of the negotiations process a letter from the employer to an employee contained reference to a settlement sum. The employer subsequently argued that the sum was not an offer but part of the negotiations. Upon receipt of the letter the employee sent a letter accepting the sum mentioned in the letter. (Newbury v Sun Microsystems [2013] EWHC 2180 (QB).
