Are computer games grounds for Unreasonable Behaviour?
20 June 2011
An online divorce provider has conducted a survey on examples of 'unreasonable behaviour' used in divorce petitions. In the survey up to 15% of divorce petitions referred to the husband spending too much time playing computer games as an example of 'unreasonable behaviour'.
A divorce petition can be based on a spouse’s unreasonable behaviour provided that the marriage has broken down irretrievably. Unreasonable behaviour is a subjective test and even snoring has been deemed to be 'unreasonable behaviour'.
We advise that examples of unreasonable behaviour should be as mild as possible to help reduce tension and to ensure that the relationship between spouses remains as amicable as possible particularly if there are children.
