Commercial lease litigation - Howell Jones successfully help client exit lease due to breach
04 October 2011
We have just completed a surrender on commercial premises.
The Landlord allowed another tenant to occupy part of the premises and implement restrictions, which gravely affected our clients' business. We were engaged to take the matter up with the Landlord, because the only way that our clients could overcome the damage to their business, was to move to alternative premises. However they had five years left under the lease. A liability of approximately £100,000.
Through negotiation we agreed a surrender on very favourable terms and in particular with no ongoing liability for rent, dilapidations or rates. Our clients were extremely pleased.
