Employment Appeals Tribunal finds that in certain circumstances parties should not be penalised for the late filing of documents.

On 2nd August 2011 an  Employment Appeal Tribunal heard an appeal from an Employment Tribunal's finding, that because a form had been lodged late, the matter could not proceed.  The Employment Appeal Tribunal found that in the light of the facts,  and given the nature of the documents that had been lodged and how the error had occurred, it was right to excercise discretion and to allow the matter to proceed despite the breach.  The appeal was therefore allowed.
