Landlord and Tenant Law - Declaration granting life tenancy set aside by Court of Appeal

On 29th November 2011 the Court of Appeal set aside a declaration granting occupiers of a property a life tenancy based on an oral contract.  The Court stated that there was nothing in the Court documents, witness statements or oral evidence to support the claim that there was a tenancy for life.  The terms were not consistent with the grant of any lease or tenancy as there was no term certain.  The appeal to set aside declaration was therefore allowed.
