On 17th January the High Court found that whilst it was difficult to determine success when parties had agreed terms, it was nevertheless necessary to look at the ultimate order to decide, on an provisional basis,  which party had been successful.  The Court could take into consideration any other arguments that may having a bearing on costs, before deciding, on balance, the correct order to make.
