The Supreme Court has found that where a property is owned by an unmarried couple in joint occupation, who both pay the mortgage, but without there being any express declaration as to their beneficial interests, the presumption is that they both own the property in equal shares. However, that presumption can , and will, in the appropriate circumstances, be rebutted by evidence.
