Summary Judgment cannot be obtained on an allegation of fraudulent misrepresentation.

In a Judgment of Henderson J of the Chancery Divison, it was held that an application for summary judgment could not succeed on an allegation of fraudulent misrepresentation.  The Judge held that the truth or mistruth of the representations could only be determined at trial following a proper evaluation of all evidence.
