The Bribery Act 2010 : are you ready?
01 July 2011
The Act repeals the old offences of bribery and creates several new offences which carry a maximum penalty of ten years' imprisonment or an unlimited fine for which employees, directors and commercial organisations can be liable.
Employers will need to take steps to ensure that adequate policies and procedures are in place in order to rely on a statutory defence to a charge of failing to prevent bribery. To achieve this employers should review all contracts of employment or service contracts and policies and procedures to ensure compliance.
