The effect of Marriage and Divorce on your Will
26 April 2011
If you marry or enter into a civil partnership then unless you have made specific provision in your existing will it will be revoked! Many testators are unaware of this effect. There are ways to avoid this and we would be happy to advise you.
If you have made your will and subsequently divorce then any reference to your former spouse appointing them as executor and or trustee will be treated as if it were omitted. Any gift to the former spouse will fail.
Our team of Trust and Estates solicitors have a wealth of experience in drafting wills. If you would like to make a will please contact the Trusts and Estates Team on 01372 860 650.
