What is the eviction process?

  • Consultation: We begin with a meeting – either online or in-person. Here, we listen to you and ask questions to fully understand your situation. We then explain how we can support you, talk you through our process and advise on how to evict your tenant legally and efficiently.
  • Document preparation: We’ll prepare your case with the required documentation, allowing you to serve a legally valid eviction notice. We’ll advise you on providing the correct evidence to support your eviction.
  • Court proceedings (if necessary): If the tenant does not leave after the notice period, we will issue proceedings to the Court and prepare the appropriate legal documents to obtain a possession order, ensuring a quick and effective eviction.
  • Bailiff enforcement (if necessary): If your tenant continues to refuses to leave after the possession order is granted, we will then instruct High Court Bailiffs to carry out the eviction. We will also arrange for the locks to be changed so you can regain full control of your property.

Landlords: Section 21 no-fault evictions will be ending

A Section 21 eviction currently allows landlords to regain possession of their property without providing a specific reason, so long as they follow the correct legal process. This applies when a fixed-term Assured Shorthold Tenancy (AST) ends, or during a rolling periodic tenancy and the landlord must give the tenant a minimum of two months’ notice.

The Government has passed legislation abolishing the non-fault eviction process, however the legislation is not yet in force. Therefore, if you wish to evict a Tenant using the section 21 process, you must act quickly now.

Once the legislation comes into effect, landlords will no longer be able to evict tenants at the end of an AST without legal grounds. This will make the eviction process more complex and restrictive.
