Q. What does “no win no fee” mean?
A. A “no win no fee” or conditional fee agreement means that if your claim fails, we will not be paid but the other party’s legal costs will be paid for through an insurance policy.
You may already have legal expenses insurance with your car, buildings or contents insurance or with a credit card. If you do not have any insurance, we can set this up for you at no cost to you.
If you succeed in your claim, you will receive 100% of your compensation and we will paid by the other party.
Q. How long have I got to make a claim?
A. If you think that you have a claim, you should try to contact us as soon as possible.
In most cases, the time limit is 3 years from the date of the accident or 3 years from the date that you became aware that you had suffered an injury or illness.
In children’s accident claims, you can bring a claim at any time before the child’s 21st birthday.
In professional negligence claims, the time limit is 6 years from the date of the professional negligence.
Different time limits can apply where the accident happened abroad or on an aircraft and that is why you must contact us as soon as possible.
Q. What can I claim for?
A. You can claim compensation for the injury itself and any psychiatric injury that you suffer. You can also claim compensation for any financial losses that you have suffered.
Financial losses include loss of earnings, travel and parking costs, cost of care received from family and friends, prescription and medication costs, cost of damaged clothing and the cost of private healthcare. It is important to retain any receipts.
Q. How much compensation will I receive?
A. The amount of compensation that you will receive will depend upon the seriousness of your injury and the financial losses that you have suffered.
We will always ensure that you receive the best compensation possible.
Q. Will there be any deductions from my compensation?
A. If we take on your claim on a “no win no fee” basis, you will receive 100% of your compensation.
Q. Who pays my compensation if I win?
A. The other party or their insurers will pay your compensation if you win your claim.
Q. What happens if my claim is lost?
A. If you do not succeed in your claim, you will not receive compensation and we will be paid. The other party’s legal costs will be paid through an insurance policy.
Q. How long will my claim take?
A. The length of a claim depends upon the type of accident and type of injury involved and whether the other party admits liability.
